Before dismissals for operational, behavioral or personal reasons are announced – where there are many pitfalls lurking for the employer – we check the legality of them for you. After notice of termination has been given, we represent you in termination proceedings.
We review and draw up your employment contracts in compliance with current case law. Through regular training that a labor law specialist has to attend, we ensure that we are always aware of the latest case law.
We will be happy to advise you if you have any doubts about the legality of warnings. We also prepare employment law warnings for you in order to consistently enforce your interests. Even small mistakes can lead to the ineffectiveness of a warning. This is particularly annoying if you want to base the termination on a warning in the process. We support you in advance and minimize the legal risks.

The dismissal protection lawsuit is the most important way to defend yourself against the employer’s dismissal. A dismissal protection claim initiates proceedings before the labor court. The effectiveness of the termination and thus the existence of the employment relationship is checked there. If you decide to file a claim for protection against dismissal, you should bring it before the labor court within three weeks of receipt of the notice of termination. If you do not adhere to this deadline, you will have missed the opportunity to sue your employer and the termination can normally no longer be challenged. Exceptions are only possible in special individual cases.
There is no legal principle that an employment relationship cannot be terminated during illness/inability to work. Accordingly, employees are not protected from dismissal if they become ill. However, if the reason for the termination is your (possibly long-standing) illness, the requirements for the termination to be effective are very high. The appendix to a dismissal protection lawsuit can be used to check whether the termination notice is effective. We also advise you in advance.
In the event of termination, one party terminates the employment relationship. This is different with a termination agreement. If both parties decide to end the employment relationship, a termination agreement is drawn up. This offers a variety of advantages for the employer, in particular he does not have to worry about a claim for protection against dismissal from the employee. From the employee’s perspective, however, a termination agreement is often associated with disadvantages. If the employee is guided by the employer’s offers without seeking legal advice, this usually leads to a block on receiving unemployment benefits. It should therefore be noted that employees should request a consultation with a labor law specialist before signing a termination agreement in order not to suffer financial disadvantages.
Die Rechtsanwaltskosten werden im Arbeitsrecht auch bei einem gewonnenen Prozess nicht von der Gegenseite erstattet. Dies gilt jedenfalls außergerichtlich und bis zum Abschluss der ersten Instanz (Arbeitsgericht). Jede Partei zahlt seine eigenen Anwaltskosten und dies unabhängig davon, wie der Rechtsstreit ausgeht. Zu empfehlen ist daher eine Rechtschutzversicherung abzuschließen, die die Kosten für die Wahrnehmung der arbeitsrechtlichen Interessen übernimmt. Im Übrigen können Streitigkeiten auch mithilfe von Prozesskostenhilfe vom Staat (vor-)finanziert werden. Außergerichtlich kann bei Vorliegen der wirtschaftlichen Voraussetzungen Beratungshilfe vom örtlich zuständigen Amtsgericht gewährt werden. Mit dem Berechtigungsschein vom Amtsgericht können Sie zu einem Rechtsanwalt Ihrer Wahl zu Rate ziehen.
